This website (the “Site”) is owned and operated by Executive Coaching Solutions, LLC d/b/a “XCS” or “Executive Coaching Solutions” (“COMPANY,” “we” or “us”). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from COMPANY. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.

We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.

Intellectual Property Rights

Our Limited License to You. This Site and all the materials available on the Site are the property of us and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal noncommercial use. You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. More specifically, unless explicitly authorized in these Terms of Service or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Site. You may, however, from time to time, download and/or print one copy of individual pages of the Site for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.

Your License to Us. By posting or submitting any material (including, without limitation, comments, blog entries, Facebook postings, photos and videos) to us via the Site, internet groups, social media venues, or to any of our staff via email, text or otherwise, you are representing: (i) that you are the owner of the material, or are making your posting or submission with the express consent of the owner of the material; and (ii) that you are thirteen years of age or older. In addition, when you submit, email, text or deliver or post any material, you are granting us, and anyone authorized by us, a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to use, copy, modify, transmit, sell, exploit, create derivative works from, distribute, and/or publicly perform or display such material, in whole or in part, in any manner or medium, now known or hereafter developed, for any purpose. You acknowledge and agree that any contributions originally created by you for us shall be deemed a “work made for hire” when the work performed is within the scope of the definition of a work made for hire in Section 101 of the United States Copyright Law, as amended. As such, the copyrights in those works shall belong to COMPANY from their creation. Thus, COMPANY shall be deemed the author and exclusive owner thereof and shall have the right to exploit any or all of the results and proceeds in any and all media, now known or hereafter devised, throughout the universe, in perpetuity, in all languages, as COMPANY determines. In the event that any of the results and proceeds of your submissions hereunder are not deemed a “work made for hire” under Section 101 of the Copyright Act, as amended, you hereby, without additional compensation, irrevocably assign, convey and transfer to COMPANY all proprietary rights, including without limitation, all copyrights and trademarks throughout the universe, in perpetuity in every medium, whether now known or hereafter devised, to such material and any and all right, title and interest in and to all such proprietary rights in every medium, whether now known or hereafter devised, throughout the universe, in perpetuity. Any posted material which are reproductions of prior works by you shall be co-owned by us.

You acknowledge that COMPANY has the right but not the obligation to use and display any postings or contributions of any kind and that COMPANY may elect to cease the use and display of any such materials (or any portion thereof), at any time for any reason whatsoever.

Limitations on Linking and Framing. You may establish a hypertext link to the Site so long as the link does not state or imply any sponsorship of your site by us or by the Site. However, you may not, without our prior written permission, frame or inline link any of the content of the Site, or incorporate into another website or other service any of our material, content or intellectual property.

Executive Coaching Solutions SMS Terms and Conditions

Please read these terms and conditions carefully. By providing your telephone number(s) and confirming your acceptance of SMS/text messages from Executive Coaching Solutions through electronic and/or digital means, you expressly consent to receive recurring non-marketing and marketing text messages from Executive Coaching including text messages made with an automatic telephone dialing system, at the telephone number(s) that you provide. Your consent is not required to purchase any goods or services. You may opt out of these communications at any time. Message and data rates may apply. Message frequency varies.

You also accept and agree to be bound by these SMS Terms and Conditions, our Terms of Use, our Privacy Policy, and any other applicable terms and agreements related to your use of Executive Coaching Solutions services. THESE TERMS AND CONDITIONS ARE SUBJECT TO AN ARBITRATION CLAUSE, WHICH AFFECTS HOW DISPUTES ARE RESOLVED.

Program Description

Executive Coaching Solutions and its service providers may use an automatic telephone dialing system to deliver text messages to you. Executive Coaching Solutions text messages are intended to provide information about Executive Coaching Solutions goods and services, including exclusive limited-time offers and promotions.

Cost

Message and data rates may apply to each text message sent or received in connection with Executive Coaching Solutions text messages as provided in your mobile telephone service rate plan, in addition to any applicable roaming charges. Please contact your mobile telephone carrier for pricing plans. Executive Coaching Solutions does not impose a separate fee for sending Executive Coaching Solutions text messages.

How to Opt In

To opt in to receive text messages from Executive Coaching Solutions, please follow the instructions provided when you enroll.

How to Opt Out

To stop receiving text messages from Executive Coaching Solutions, use the mobile phone corresponding to the number enrolled in Executive Coaching Solutions text messages and reply “STOP” in response to a text message from the Executive Coaching Solutions text messaging program or text “STOP” to (678) 932-8865. You will then receive confirmation of your opt-out. This will only opt you out of the specific text messaging program associated with that phone number, and you will remain opted into any other text messaging programs where you have enrolled.

Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying Executive Coaching Solutions immediately if you change your mobile telephone number. You may notify Executive Coaching Solutions of a number change by emailing [email protected].

You agree to indemnify Executive Coaching Solutions in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Executive Coaching Solutions if you change your telephone number, including but not limited to all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act and state telemarketing laws.

Privacy

Your privacy is critically important to us. At Executive Coaching Solutions we have a few fundamental principles:• We don’t ask you for personal information unless we truly need it. (We can’t stand services that ask you for things like your gender or income level for no apparent reason.) • We don’t share your personal information with anyone except to comply with the law, develop our products, or protect our rights. • We don’t store personal information on our servers unless required for the on-going operation of one of our services. • In our blogging products, we aim to make it as simple as possible for you to control what’s visible to the public, seen by search engines, kept private, and permanently deleted.

Website Visitors

Like most website operators, Executive Coaching Solutions collects non-personally identifying information that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Executive Coaching Solutions' purpose in collecting non-personally identifying information is to understand better how Executive Coaching Solutions also collects potentially personally-identifying information like Internet Protocol (IP) addresses. The Coaches’ Coach does not use such information to identify its visitors, however, and does not disclose such information other than under the same circumstances that it uses and discloses personally identifying information, as described below.

Gathering of Personally Identifying Information

Certain visitors to the Executive Coaching Solutions website choose to interact with Executive Coaching Solutions in ways that require Executive Coaching Solutions to gather personally identifying information. The amount and type of information that Executive Coaching Solutions gathers depends on the nature of the interaction. For example, we ask visitors who sign up for our products and services to provide a username and email address. Those who engage in transactions with Executive Coaching Solutions – by purchasing access to the membership services, for example – are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. If you are a registered user of a The Coaches’ Coach website and have supplied your email address, The Coaches’ Coach may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with The Coaches’ Coach and our products. We primarily use our various product blogs to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. The Coaches’ Coach takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. The Coaches’ Coach uses cookies to help The Coaches’ Coach identify and track visitors, their usage of The Coaches’ Coach website, and their website access preferences. The Coaches’ Coach visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using The Coaches’ Coach’s websites, with the drawback that certain features of The Coaches’ Coach’s websites may not function properly without the aid of cookies.

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by The Coaches’ Coach and does not cover the use of cookies by any advertisers.

Comments

Comments and other content submitted to our anti-spam service are not saved on our servers unless they were marked as false positives. We store them long enough to use them to improve the service to avoid future false positives.

Privacy Policy Changes

Although most changes are likely to be minor, Executive Coaching Solutions may change its Privacy Policy from time to time

Access or Delivery to Mobile Network Is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of the control of Executive Coaching Solutions, and Executive Coaching Solutions is not responsible or liable for issues arising from them.

Eligibility

To receive Executive Coaching Solutions text messages, you must be 18 years of age or older. Executive Coaching Solutions reserves the right to require you to prove that you are at least 18 years of age.

Changes to Terms and Conditions

Executive Coaching Solutions may revise, modify, or amend these SMS Terms and Conditions at any time. We will provide notice of any such revision, modification, or amendment through reasonable means, including but not limited by email to any email address you provide or by text message to any telephone number you provide. Said revision, modification, or amendment shall not apply retroactively and will not be effective until seven (7) days after we provide notice. If you do not agree to the revision, modification, or amendment, you must opt-out of Executive Coaching Solutions text messages within the 7-day notice period. If you do not opt-out, you will be deemed to have accepted the revision, modification, or amendment.

Termination of Text Messaging

Executive Coaching Solutions may suspend or terminate your receipt of Executive Coaching Solutions text messages for any reason, including if Executive Coaching Solutions believes you are in breach of these SMS Terms and Conditions. Your receipt of Executive Coaching Solutions text messages is also subject to termination if your mobile telephone service terminates or lapses. Executive Coaching Solutions reserves the right to modify or discontinue, temporarily or permanently, all or any part of Executive Coaching Solutions text messages, with or without notice.

Communications and Consent to Electronic Notices

You may communicate with Executive Coaching Solutions via email, telephone, and our website. Executive Coaching Solutions may issue notices via various channels, including by sending email to an address you provide. You agree that such notices shall have legal effect.

You also agree that notices sent by email satisfy any requirement that notices be provided in writing. If you do not agree, do not use Executive Coaching Solutions products or services.

Your consent to receive electronic communications applies to this transaction and any future transaction which may arise out of this transaction. You may have the right to withdraw your consent to receive certain electronic communications, and when required by law, Executive Coaching Solutions will provide you with paper copies upon request at no charge. You may make such a request via any of the channels listed above. If you withdraw your consent, Executive Coaching Solutions reserves the right to terminate your use of Executive Coaching Solutions products or services.

To receive, access, and retain the notices that Executive Coaching Solutions sends via email, you must have Internet access and a computer or device with a compatible web browser. You will also need software capable of viewing files in PDF format. Your device or computer must have the ability to print, or download and store, e-mails and PDF files. By accepting these terms, you confirm that you can receive, access, and retain the notices that Executive Coaching Solutions may send.
